These Terms & Conditions apply to all purchases made through Bites to Share (“Bites to Share”, “we”, “us” or “our”), including purchases made through our website at bitestoshare.com.
By placing an order with us, you agree to these Terms & Conditions.
1. Products
Bites to Share creates and sells cookies, macarons and other baked and dessert products.
We make our products by hand, and therefore minor variations in colour, size, shape, decoration and appearance may occur. These variations are a natural part of handmade products and do not affect the quality of the product.
For custom orders, colours and designs may vary slightly from digital images or reference materials due to screen settings, printing, edible colours and the handmade nature of our products.
2. Orders
Orders are subject to availability and our production capacity.
An order is considered confirmed once payment has been successfully received and an order confirmation has been issued by Bites to Share.
For custom orders, including custom cookies, macarons and printed products, we may require design details, artwork, wording, colours or other information before the order can be confirmed.
Customers are responsible for checking their order details, including:
product selection;
quantity;
flavour;
design;
spelling and wording;
delivery or collection date;
delivery address; and
any other personalised information supplied to us.
Once an order has entered production, changes may not be possible.
3. Custom Orders
Custom orders are made specifically for the customer and may involve personalised designs, colours, names, logos, images or other specifications.
Customers must ensure that any artwork, logos, photographs or other materials supplied to Bites to Share may lawfully be used for the purpose of producing the order.
We reserve the right to decline a custom design where we consider it unsuitable, technically impractical or unable to be produced to an acceptable standard.
4. Pricing and Payment
All prices are displayed in Australian dollars unless otherwise stated.
Prices may change from time to time. The price applicable to an order is the price displayed or quoted at the time the order is placed.
Payment must be received before an order is considered confirmed unless otherwise agreed in writing.
For custom or large orders, a deposit or full payment may be required before production commences.
5. Product Availability
We reserve the right to limit quantities, refuse an order or cancel an order where a product is unavailable, ingredients are unavailable, or we are unable to fulfil the order.
If we cancel an order because we are unable to fulfil it, any payment received for the affected order will be refunded.
6. Allergens and Dietary Requirements
Our products may contain allergens including, but not limited to, wheat/gluten, eggs, milk, soy, peanuts and tree nuts.
Our products are produced in an environment where multiple allergens may be present.
Customers must contact us before ordering if they have an allergy or dietary requirement.
While we take reasonable steps to manage allergens and provide accurate allergen information, we cannot guarantee that any product is completely free from allergen cross-contact.
Allergen information will be provided in accordance with applicable food laws and regulations.
7. Delivery
Delivery dates and timeframes provided by Bites to Share or a third-party delivery provider are estimates unless a specific delivery commitment has been expressly agreed.
Once an order has been dispatched or handed to a delivery provider, delivery may be affected by circumstances outside our control.
Customers are responsible for providing an accurate and complete delivery address.

8. Collection
Where collection is offered, customers must collect their order at the agreed date, time and location.
Orders that are not collected may be subject to additional storage, redelivery or other reasonable charges where applicable.
9. Food Quality and Storage
Our products are freshly made and should be stored and consumed in accordance with the storage instructions provided with the order.
Customers are responsible for storing products appropriately once they have been delivered or collected.
10. Intellectual Property
All website content, photographs, product designs, logos, branding, written content and other materials belonging to Bites to Share remain the property of Bites to Share or their respective owners.
You may not reproduce, copy, modify or commercially use our content without prior written permission.
11. Website Information
We take reasonable care to ensure that information on our website is accurate and up to date. However, minor errors, omissions or changes may occur.
Nothing in these Terms & Conditions excludes or limits any rights or guarantees that cannot legally be excluded under Australian Consumer Law.
12. Australian Consumer Law
Nothing in these Terms & Conditions is intended to exclude, restrict or modify any consumer guarantee, right or remedy available to you under the Australian Consumer Law or other applicable legislation.
Where the Australian Consumer Law applies, you may be entitled to a repair, replacement, refund or other remedy depending on the circumstances.
13. Limitation of Liability
To the extent permitted by law, Bites to Share will not be liable for loss or damage caused by circumstances outside our reasonable control.
Nothing in these Terms & Conditions excludes liability that cannot legally be excluded under applicable law.
14. Events Outside Our Control
We will not be responsible for delays or failure to fulfil an order caused by circumstances beyond our reasonable control, including severe weather, natural disasters, transport disruptions, accidents, power outages, supplier issues or other unforeseen events.
Where such an event occurs, we will take reasonable steps to communicate with affected customers and find an appropriate solution.
15. Changes to These Terms
We may update these Terms & Conditions from time to time.
The version applying to an order will generally be the version available at the time the order was placed.

17. Governing Law
These Terms & Conditions are governed by the laws of New South Wales, Australia.
You agree that any disputes arising in connection with these Terms & Conditions will be subject to the applicable courts and laws of New South Wales, Australia, subject to any rights you may have under Australian Consumer Law.
